تتعدد أشكال القرارات الصادرة من الهيئة العامة للمنافسة؛ فتكون إما الموافقة، أو الموافقة المشروطة والتي تكون مسببة وتتم متابعة الامتثال لشروط القرار، وفي حال عدم التقيّد بها يتم سحب الموافقة بعد (30) ثلاثين يومًا من توجيه إنذار كتابي، أو بالرفض ويكون مسبّبًا كذلك. ويصدر القرار خلال مدة لا تتجاوز (90) تسعين يومًا من تاريخ اكتمال المستندات وسداد المقابل المالي، وهوَ نسبة (%0,0002) من إجمالي قيمة المبيعات السنوية للمنشآت المشاركة في التركز الاقتصادي على ألا تتجاوز النسبة مبلغ (250,000) مئتان وخمسون ألف ريال سعودي.
أما في حال مضي المدة النظامية لدراسة التركز الاقتصادي وعدم صدور قرار بشأن الطلب؛ فيعد ذلك بمثابة موافقة ضمنية، كما يمكن أن يكون القرار محددًا بمدة صلاحية ونطاق جغرافي معين، وفي حال سحب الطلب وعدم المضيّ فلا تُسترد المبالغ المدفوعة للدراسة.
ومن التبعات التي أقرها النظام ولائحته التنفيذية لعدم الإبلاغ عن التركز الاقتصادي؛ الخضوع لغرامة لا تتجاوز نسبة (10%) عشرة بالمائة من المبيعات السنوية، أو غرامة لا تتجاوز ثلاثة أضعاف المكاسب التي حققها المخالف نتيجة المخالفة، إلا أنه تمنح الهيئة العامة للمنافسة إعفاءً من أحكام نظام المنافسة فيما يخص الإبلاغ عن التركز الاقتصادي بناءً على توصية من لجنة فنية في أحوال معينة يتم مراعاتها عندما تكون النتيجة منها تحقق أهداف النظام، ويكون الإعفاء بموجب طلب يتم تقديمه وفق نموذج محدد من الهيئة موضحًا فيه النتائج الإيجابية ومسببّات طلب الإعفاء مصحوبًا بالمستندات ذات الصلة.

Economic Concentration
The General Authority for Competition issues various types of decisions, including approval and conditional approval, which requires monitoring compliance with the conditions set in the decision. If the conditions are not adhered to, the approval may be withdrawn after a written warning is issued within (30) days. The decision can also be a rejection, which is also based on specific reasons. The decision is issued within a period not exceeding 90 days from the date of completion of the documents and payment of the financial consideration. The financial consideration is calculated at a rate of (0.0002%) of the total annual sales value of the entities involved in the economic concentration, not exceeding (250,000) two hundred and fifty thousand Saudi Riyals.
If the statutory period for studying economic concentration elapses without a decision being issued, it is considered an implicit approval. The decision can also specify a certain validity period and geographical scope. If the application is withdrawn and no progress is made, the fees paid for the study are not refunded.
The consequences stipulated by the Law and its executive regulations for failure to report economic concentration include being subject to a fine not exceeding (10%) of annual sales, or a fine not exceeding three times the profits gained by the violator as a result of the violation. However, the General Authority for Competition may grant an exemption from the provisions of The Competition Law regarding reporting economic concentration based on a recommendation from a technical committee in specific circumstances that achieve the objectives of the Law. The exemption is granted upon request submitted according to a specific model provided by the authority, detailing the positive results and the reasons for requesting the exemption, accompanied by relevant documents.
