نصّ نظام الشركات السابق على العديد من القيود الواردة على أسماء الشركات، وأحكام خاصة بكل شكل من أشكال الشركات، ومنها اشتراط كتابة أسماء جميع الشركاء في شركات التضامن أو اسم واحد منهم مع إضافة كلمة “وشركاه”، إلى أن جاء نظام الشركات الجديد بإلغاء القيود الواردة على أسماء الشركات، ووضع نصّ عام يشمل كافة أنواع الشركات بأن تتخذ اسمًا مبتكرًا أو مشتقًا من غرضها وفقَ أحكام عامة، وذلك تسهيلًا لبيئة الأعمال.
* تناقش هذه السلسة أبرز التحديثات الصادرة في نظام الشركات الجديد الصادر بالمرسوم الملكي رقم (م/132) وتاريخ 01/12/1443هـ والذي دخل حيز النفاذ في تاريخ 07/06/1444هـ، أي بعد حوالي ست سنوات فقط من تاريخ صدور النظام السابق في عام 1437هـ.

Removing the restrictions imposed on Company Names
The previous Companies Law imposed various restrictions on company names and included specific provisions for each type of company. For example, it required all partners’ names to be listed in general partnership companies or the use of one partner’s name with the addition of the word ” And its partners” (meaning “partnership”). However, the new Companies Law issued in 1443 AH abolished the restrictions on company names and introduced a general provision applicable to all types of companies. According to this provision, companies are allowed to adopt innovative or derived names based on their purpose, facilitating a business-friendly environment.
* This series discusses the key updates issued in the new Companies Law issued by Royal Decree No. (M/132) dated 01/12/1443H, which came into effect on 07/06/1444H, approximately six years after the issuance of the previous law in 1437H.
